Hello All,
am hoping somebody will have a few ideas as how best to handle this situation and what my rights are - I've been researching on the internet and can't find any useful information.
The company I'm employed by is doing really badly (so they tell me) and have put all wages on hold, including my maternity pay. They owe me my Statutory Maternity Pay for both July and August. I understand that if the company goes insolvent that I can eventually claim the unpaid wages back from Revenue and Customs (according the directgov website) but they aren't insolvent yet (although it doesn't look good), so what can I do in the meantime? My boss has always been unreliable and a nightmare, we really need the money and I don't know where to go next. Citizens advice beaureaux seem to have very limited opening hours and phone-in times that always seem to be at the most inconvenient times so I've not managed to get hold of anyone there yet, although that is my next port of call. I would really like to know what my rights are and whether what my boss is doing is illegal.
Any advice appreciated.

I would try citizens advice, I am pretty sure this is illegal, they cannot hold you SMP unless they go under, I am pretty sure of that. You really need professional advice though.
Sorry not much help I am afraid. I have a book upstaires about work & pregnancy I will go and have a look and see if there is anything in there for you. If I get some info I will post it on here.

All I could find was this - an organisation called Working Families www.workingfamilies.org.uk http://www.workingfamilies.org.uk Tel: 0800 0130313 for Advice on maternity and paternity benefits, the Child Trust Fund, Tax Credits,and other benefits, and on the right to request flexible working.
