Hi,
Dont know if this is really the place to put this, but just looking for some advice for a family member.
He has just broken up with his long term girlfriend (10 year relationship) and they have kids together. She has had an affair and now left the family home to be with this man after my family member told her to go.
She didnt want all of the children, just one, and the father wouldnt let her take any of them.
Im just wondering what happens now. I know they will have to figure something out in regards to visitation if she even wants it, but what if she has the kids for a day and doesnt give them all back? Is there anything he can do to prevent this happening?
They were never married and he has parental rights over the youngest 2 but the oldest was born before the law change so he doesnt have parental rights for that child. What can he do now?
The family are all getting stressed about this as we dont know what she will do next but we know the kids would not be looked after right if she has any of them and why break up the children when there is a parent who will have them all and not just one? Plus he will have the whole family's support whenever he needs us.

You need to get legal advice. CAB is a good start, and hopefully they can start some sort of mediation to set up something everyone agrees with.

Citizens Advice Bureaux [CAB] will be able to help with legal advice. The service is free. I can't help you myself, as I know very little about the law, but CAB will be able to. Just advise the father to be clear and direct when talking to citizens advice people.

Seems to me an urgent trip to a solicitor who specialises in family law would be in order here. I think some sols will give you a half hour free consultation so it's worth asking about that.

I think he will need to apply to the court for parental responsibility for the eldest child and a solicitor would be best placed to advise on this.

I love the CAB they do a great job - but in my experience they are really busy and often just getting an appointment can take some time I think if this were happening in my family I'd get me to the professionals right away.
